Terms of Service

Welcome to Modbuilt. These Terms of Service ("Terms") govern your access to and use of the services, websites, design consultations, prefabrication engineering, and modular delivery systems provided by Modbuilt ("Company," "we," "our," or "us").

1. Acceptance of Terms

By requesting a feasibility study, accepting a design quotation, visiting our office at A16/24-32 Lexington Dr, Bella Vista, or signing a modular manufacturing agreement, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.

2. Design and Pre-Engineering Stage

Modbuilt uses advanced 3D BIM modeling and clash detection for modular building design.

• All preliminary sketches, layout concepts, and digital renders remain the intellectual property of Modbuilt unless explicitly transferred under a design contract.
• Engineering drawings and structural certifications require written sign-off from the client before factory fabrication begins. Any alterations requested after sign-off will incur variation fees and timeline adjustments.

3. Manufacturing & Factory Acceptance Testing

All modular buildings (including Space Capsules, Apple Cabins, Prefab Houses, and Office Pods) are manufactured in strict climate-controlled environments aligned with National Construction Code (NCC) standards.

• Factory Inspections: Clients are welcome to schedule inspections at designated manufacturing milestones. Factory Acceptance Testing (FAT) will be carried out before modules are packed for transport.
• Payment Schedules: Modular projects operate under structured progress payments (Deposit, Pre-production, Framing completion, FAT approval, and Delivery). Fabrication will pause if progress payments are delayed.

4. Logistics, Site Access & Installation

Volumetric modular construction requires specialized transportation and high-capacity crane installation.

• The client is responsible for ensuring clear, stable, and legal vehicular access to the site for heavy prime movers and mobile cranes.
• Unless explicitly stated in the scope of works, foundation preparation (screw piles, concrete piers, footing systems), connection to mains utilities (sewer, water, electrical), and local council planning approvals remain the responsibility of the client.

5. Warranties & Defect Liability

Modbuilt provides a comprehensive 12-month defect liability period on all prefabricated modules starting from the date of practical completion. Structural warranties conform to Australian Consumer Law (ACL) statutory requirements.

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New South Wales, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of NSW.
